MAZZONE, District Judge.
This is an action brought by the Secretary of Labor (the Secretary) to enforce the overtime provisions of the Fair Labor Standards Act (FLSA), 29 U.S.C. § 207(a)(1) (FLSA) as they apply to Associate Managers at Papa Gino’s. Papa Gino’s has moved for summary judgment claiming that the Associate Managers qualify as “bona fide executives” and, as such, are exempt from the overtime wage provisions codified at 29 C.F.R. § 541.1.
