— This was ah action before the mayor of Crawfordsville to recover a penalty for the violation of a city ordinance. The ordinance provides that any person who shall sell, barter, or give away, within the city limits, or within-two miles thereof, any spirituous, vinous or malt liquors, in a less quantity than a quart at a time, to be used or drunk on the premises, without having first procured from the clerk of the city a license so to do, shall, on conviction thereof, forfeit and pay a penalty of not less than ten nor more than fifty dollars for each offence.
