Rhodes, J.:

This is an application to confirm the report of commissioners appointed to ascertain and report as to damages and compensation to be awarded to the defendants for property taken by the city of Binghamton in proceedings brought to condemn the same. The property of the defendants Mason which is being acquired is on the west side of the Chenango river, constituting a portion of the approach to the bridge which the city is constructing.
