Relator, Albert Maringer, has filed this original action requesting that this court issue a writ of mandamus ordering respondent Industrial Commission of Ohio to vacate an order denying relator’s April 13, 1988 motion for change of election to receive compensation on the basis of impairment of earning capacity under former R.C. 4123.57(A), as well as his request for an increase in his percentage of permanent partial disability to fifty percent.
