This is an appeal from a judgment of the Appellate Court for the Second District, affirming a judgment of the circuit court of Will county, rendered against appellant, in favor of appellee, in an action to recover damages for the loss of a leg while the appellee was engaged in the service of the appellant. The case has been twice tried. The first judgment was reversed on the ground that the declaration was insufficient. (Joliet Steel Co. v. Shields, 134 Ill. 209.) After the cause was remanded the declaration was amended, and a second trial resulted in a judgment for $5000 for the plaintiff,…
