Plaintiff obtained a judgment in the sum of $40,000 against appellant railway company in the Circuit Court of the City of St. Louis, Missouri. An appeal was perfected to this court.

Plaintiff's suit was brought under the Federal Employers' Liability Act. It was based upon a violation of the Boiler Inspection Act and common law negligence. On July 28, 1945, plaintiff, a fireman, was a member of a train crew operating a freight train between Clinton and Springfield, Missouri.
