MEYER, Justice.

On 23 December 1991, Carolina Water Service Company (“CWS”) filed an application with the North Carolina Utilities Commission for an increase in its rates for water and sewer service to its retail customers in North Carolina so as to increase annual revenue by approximately $1,553,773, or 20.8%. In the application, CWS proposed to make the rate increase effective on 1 February 1992. In an order issued 23 January 1992, the Commission determined that the application constituted a general rate case and suspended the proposed rate increase for a period up to 270 days.
