—Judgment unanimously modified on the law and as modified affirmed and matter remitted to Supreme Court for resentencing in accordance with the following Memorandum: Supreme Court did not abuse its discretion in denying the motion of defendant to withdraw his plea of guilty (see, CPL 220.60 [3]; People v Muccigrosso, 269 AD2d 754, Iv denied 95 NY2d 800; People v Peavy, 225 AD2d 1082, 1083, Iv denied 88 NY2d 883).
