Plaintiff International Swaps and Derivatives Association, Inc. (“Plaintiff’ or “ISDA”) created a copyrighted form agreement to be used by individuals or businesses that enter into derivatives transactions. The completed documents are often submitted to the SEC for public filing and made available on “EDGAR,” a statutorily-created, but privately-run website designed by Congress to provide greater public access to SEC filings.
