KRENTZMAN, District Judge.

This matter came before the court upon cross motions for summary judgment and the court having reviewed the pleadings in this cause, Request for Admis sions and answers thereto, the Stipulation of the parties, and having heard argument of counsel hereby makes the following Findings of Fact and Conclusions of Law.
