ROBERT L. CARTER, District Judge.

Defendant Hasbro, Inc. (“Hasbro”) moves pursuant to Rule 12(b)(6), F.R.Civ.P., to dismiss plaintiffs complaint in its entirety, and in the alternative pursuant to Rule 56, F.R.Civ.P., for summary judgment against plaintiff on all claims.

For the purposes of this motion to dismiss, the court will assume the truth of the following facts asserted in plaintiffs complaint, and it will not dismiss the cause of action “unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief.” Conley…
