The first objection taken on the part of the defendant is, that tMs is really and essentially an action to set aside and avoid a patent, and that a state court has no jurisdiction of the subject matter of the suit. If tMs were a correct view of the nature and object of the action, the objection to the jurisdiction of the state court might be insurmountable.
