Plaintiff filed this bill in equity to enjoin defendant from erecting a building on Lancaster Avenue in Ardmore within the limits of what he claims to be a private street laid out by Mm, known as Walton Avenue, opening at right angles into Lancaster Avenue, when the land now owned by defendant was part of a large tract belonging to plaintiff, the alleged street having been created, so he avers, for the benefit of his, plaintiff’s, remaining land and for the owners of other properties along its route purchased from him.
