On April 26, 2004, the plaintiffs, Karla and William Cossey, filed their Sixth Amended Complaint against Defendants Associates’ Health and Welfare Plan (“the Plan”) and Administrative Committee, Associates’ Health and Welfare Plan (“the Committee”), alleging violations of the Employee Retirement Income Security Act, 29 U.S.C. § 1001 et seq.
