Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the State Commissioner of Social Services which directed budgeting of the income of petitioner’s former husband against the needs of their three children. Petitioner is the recipient of public assistance in the form of aid to dependent children on behalf of her three children and a granddaughter.
