When a partner in a law firm is one of three commissioners on the Public Employment Relations Commission (PERC/Commission), may her law firm represent a client before that Commission or an independent hearing examiner if the individual partner disqualifies herself from any participation in the matter? We conclude that the law firm may continue its representation of the client under the applicable statutes, the appearance of fairness doctrine, and the disciplinary rules of the Code of Professional Responsibility.
