This matter is before' the Court on DEFENDANTS’ SECOND MOTION FOR SUMMARY JUDGMENT (ECF No. 156). For the reasons set forth herein, the motion will be denied.

BACKGROUND

On December 11, 2013, Plaintiff Kelvin Thomas (“Thomas”) filed a class action complaint on behalf of himself and all others similarly situated, alleging that defendant FTS USA, LLC (“FTS”), a subsidiary of UniTek Global Services, Inc. ((“Uni-Tek”); collectively, “Defendants”) had violated the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. (“FCRA”).…
