This is an appeal from a judgment of the. district court for Douglas county in an action for personal injuries sustained by the plaintiff on account of the alleged negligence of the defendant.
An examination of the record will show the following facts: F. P. Kirkendall & Company was running a shoe factory in the city of Omaha, and the appellee was in the employ of that company at the time he received the injuries for which the judgment in this action was recovered.
