These two interlocutory appeals are from the orders of the trial court denying appellants’ motions for summary judgment against appellees/plaintiffs Margie Jane Churchwell and Charles Church-well. Appellants/defendants in Case No. A96A0600 are Mutual Life Insurance Company and Ares Development Company; appellant/ defendant in Case No. A96A0601 is W. K. Barber Construction Company.
