Steve McGarity was injured when he made contact with a live electrical wire while visiting real property that was being advertised for sale. McGarity filed a personal injury action against Hart Electric Membership Corporation (HEMC), which had installed and maintained the electrical wire (on private property on which it had an easement), alleging that HEMC had negligently maintained and inspected the wire.
