Richard Lee (“Plaintiff’) brings this action individually and on behalf of all other persons similarly situated against former employer, ABC Carpet & Home,1 Jerry Weinrib, and Paul Chapman (collectively “Defendants”) to recover unpaid overtime wages and liquidated damages. Plaintiffs claims are based on violations of the Fair *196Labor Standards Act (FLSA), 29 U.S.C. §§ 201 et seq. and 29 U.S.C. § 216(b); and the New York Minimum Wage Act, N.Y. Lab.
