The procedural history of this case is complicated. We shall set out only the parts necessary to a decision. The case was commenced December 11, 1942, following a raid of the premises on the 7th. The relator was Francis J. Nuble, then county attorney; the defendants, S. Marks, as owner, and Alphonso Bisignano (alias “Babe Camera”) and his brother Frank, as tenants of the premises. No pleading was filed or appearance entered by any defendant until December 1945. In the meantime the ownership of the premises changed and the case was dismissed as to defendant Marks.
