MORROW, Judge.
The appellant was convicted of murder, and punishment fixed at confinement in the penitentiary for a period of thirty-five years. The case of Finks v. State, 84 Texas Crim. Rep., 536, 209 S. W. Rep., was for the same homicide, and some of the matters there discussed are pertinent to this appeal.
The State, in the development of its case, introduced against the appellant three confessions. The first was in writing, hearing date the twenty-eighth day of July, 1917. The second was a verbal confession testified to by Sheriff Plott, and claimed by him to have been made at Waco on the…
