Plaintiff in error brought suit in the superior court of Cook county against defendant in error to recover damages for a personal injury alleged to have been caused by the negligence of the defendant. At the close of all the evidence offered on the trial the court instructed the jury to find the defendant not guilty. The jury so found, and judgment was rendered against the plaintiff for costs. On appeal the Appellate Court affirmed the judgment and denied plaintiff’s motion for an appeal and for a certificate of importance.
