Plaintiff Sierra Creason, a minor, and her parents, plaintiffs Claudia and Matthew Creason, sued defendant State of California (acting through the State Department of Health Services (Department)), seeking damages allegedly arising from the state’s failure to diagnose and report timely and accurately that Sierra was suffering from congenital hypothyroidism. The trial court sustained defendant’s demurrer to the first amended complaint without leave to amend and dismissed the action.
