In this insurance coverage suit, appellant Mid-Continent Casualty Co. (“Mid-Continent”) sued appellees JHP Development, Inc. (“JHP”) and TRC Condomini- urns, Ltd. (“TRC”), seeking a declaratory judgment that it had no duty to defend or indemnify JHP or pay any damages awarded to TRC in a state court suit between those two parties stemming from JHP’s defective construction of a five-unit condominium project in San Antonio, Texas. The district court held that Mid-Continent had a duty to defend and indemnify JHP pursuant to a commercial general liability insurance policy…
