In separate trials, appellant was convicted of embezzling money as the agent of John Sheehy, $3,000.00 in one case and $5,000.00 in the other, and sentenced to a three year term in the penitentiary in each case. Appellant has treated both appeals in one brief and we will treat them both in one opinion.

At the time of the trials Sheehy was 86 years old and for some time had lived in a home at 3655 Washington Street, St. Louis, which was rented from a real estate comp any by Mrs. Ida Cook. In January, 1944, Sheehy began to negotiate with the real estate company in an effort to purchase the…
