Employer Desert Hospital petitions for review of a decision and order by the National Labor Relations Board (“NLRB” or “the Board”) finding that it had committed an unfair labor practice by refusing to bargain with the California Nurses Assoeiation/Amer-iean Nurses Association (“CNA” or “the Association”), in violation of sections 8(a)(5) and (1) of the National Labor Relations Act (“NLRA” or “Act”), 29 U.S.C. §§ 158(a)(5) and (1).
