This is an action in re-plevin instituted in the district court of Alfalfa county on the 9 th day of July, 1937, by O. L. Butts, as plaintiff, against J. F. Ashcraft, as defendant. The plaintiff asserted a chattel mortgage lien on an automobile owned and possessed by the defendant and claimed by him to be free from plaintiff’s alleged lien. The cause was tried to the court without the intervention of a jury on the 21st day of January, 1938, resulting in a judgment for the plaintiff.
