NETTESHEIM, Judge.

This case is before the court on defendant’s renewed motion to dismiss pursuant to RUSCC 12(b)(1) for lack of jurisdiction over the subject matter. To be decided is the issue whether defendant’s failure to obtain a release of a debt owed by plaintiff to a third party constitutes a breach of an implied-in-fact contract over which the court has jurisdiction. The court denied in part and granted in part defendant’s original motion to dismiss pursuant to RUSCC 12(b)(4) for failure to state a claim for relief. Goolsby v. United States, 21 Cl.Ct. 88 (1990).
