Before the Court is a motion for summary judgment (No. 117) filed by Plaintiff Wells Real Estate Investment Trust II, Inc. (“Wells”), and Defendant Chardón/Hato Rey Partnership, S.E.’s (“Chardón/Hato Rey”) opposition thereto (No. 136). Also before the Court is a motion for partial summary judgment filed by Defendant (No. 131), along with Plaintiffs opposition thereto (No. 134).
