This action arises out of a letter written by Dr. Ann Kim disclosing her patient Michael McNair’s confidential medical history and health conditions. Dr. Kim sent the letter to the Department of Motor Vehicles (DMV) against McNair’s wishes due to public safety concerns. As a result, McNair’s commercial driver’s license was temporarily revoked, and he lost his job as a bus driver.
