Opinion
LILLIE, Acting P. J.
Petitioner city filed petition for writ of review claiming it was not an employer of Charles Calvert, the injured employee within the meaning of Labor Code section 5500.5 1 during the last five years of Calvert’s employment or within five years of the “date of injury” and accordingly, should have been dismissed as a defendant in Calvert’s claim for workers’ compensation benefits.
