John T. Cummings, judge of the city court of Kewanee, filed his petition in this court for a writ of mandamus against the county commissioners, the comptroller, and the sheriff of Cook county. The defendants filed a motion to strike the petition and to dismiss. The cause is at issue on the pleadings.
