Appeal from Civil District Court, Parish of Orleans: Fred D. King, Judge. Action by Robert P. De Renzes against his wife. Judgment for plaintiff, and defendant appeals.

This is a suit for divorce on the ground of adultery.

The first question is as to the name in which the suit has been brought. Plaintiff was married .under the name of Robert Palestine, and goes by that name in the community in which he lives, and yet the suit is brought in the name of Robert Palestine De Renzes. The Code of Practice requires that the petition shall mention “the name, surname and place of residence of the plaintiff.” Article 172. This means that the plaintiff shall bring suit in his real name; not in a fictitious name. Especially in a' case like the present one, involving…
