The proceedings complained of in this ease were based upon an account filed against the county of Dubois by Toliver Wertz for making a pod-inortem examination of the body of John E. Gardner, a person who had come to his death by violence, at the request of a justice of the peace, who was at the time acting, or assuming to act,, as coroner of the county.
