This action for collection of freight charges under 49 U.S.C. § 10761 is before the court on Plaintiff’s motion to strike Defendant’s affirmative defenses and counterclaims.
This case arises from shipping transactions engaged in between Plaintiff and Defendant. Plaintiff and Defendant negotiated certain rates for which Plaintiff would ship Defendants’ goods to various locations.
