This suit arises as the result of a contract entered into by plaintiff, Fehlhaber Pile Co., Inc.,1 a New York Corporation, with the defendant, acting through the War Department, for the construction of the substructure for the Chesapeake City Highway Bridge located at Chesapeake City, Maryland.
