Appellant, a thirteen-year-old boy, was tried under an indictment charging him with the crime of murder in the second degree, and was convicted of voluntary manslaughter and his punishment fixed at two years in the penitentiary, and he has appealed.

His defense was that the killing was an accidental oné, and the case was tried on that theory. Certain assignments of error relate to the admission and exclusion of testimony; but we find no érror in these respects.
