LUSK, J.

The defendant State Industrial Accident Commission made an order denying to the plaintiff the benefits of the Workmen’s Compensation law and refusing to file his claim for the reason that it had not been received within three months after the date upon which the injury occurred. The plaintiff applied for a rehearing, which was granted, and the commission, after rehearing, entered an order adhering to its former decision, and from that order the plaintiff appealed to the circuit court.
