BRIAN BARNETT DUFF, District Judge.

Two benefit funds, the Laborers’ Pension and Welfare Funds of the Health and Welfare Department of the Construction and General Laborers’ District Council of Chicago and Vicinity, in conjunction with the union which created them filed a six-count complaint in this court against Litgen Concrete Cutting and Coring Company and its president, William R.
