BROWN, Justice.

- ■ The appellant Pate was tried and convicted in the Circuit Court of Tuscaloosa County of manslaughter in the first degree. The j’udgment of conviction was entered on April 11, 1941. On May 9, 1941, he filed a motion for new trial, which, after the expiration of 30 days, beginning on and including April 12, was on May 16th, called to the court’s attention and was by the court continued to a day certain.
