Appeal from Morgan Circuit Court. Heard before Hon. D. W. Speake. Action by John B. Shelton against Thomas R. Shipp, as sheriff, and his sureties on his official bond, for trespass. There was a judgment for plaintiff, and defendants appealed to the Court of Appeals, and it transferred the case, under Act April 18, 1911 (Laws 1911, p. 450) § 6, to the Supreme Court.

This is an appeal from the judgment of the circuit court of Morgan county, rendered on the 28th day of October, 1912. The bill of exceptions was presented on January 2, 1914, to the judge who presided at the trial of the cause, and by him sighed on April 1, 1914, and the appeal was taken on the 1st day of May, 1914.
