— Plaintiff, E. J. Auve, brought this action upon the guarantee note of defendants, which guaranteed to the extent of five thousand dollars the note of Falls Creek Mines, Inc., of face value of ten thousand dollars. Both notes were a part of one transaction. Defendants answered, alleging payment and usury. The receiver of Falls Creek Mines, Inc., hereinafter called the receiver, intervened, asking recovery from plaintiff of money paid on its note, because of the usurious nature of transaction.
