At the January term, 1878, of the court below, the appellant was indicted by the grand jury of said ■court and term, for murder in the first degree.

Omitting the formal and introductory matter of said indictment, it charged, in substance, that the appellant, •“ on the 24th day of December, A. D. 1877, at and in the county of Marion and State of Indiana, did then and there unlawfully, purposely, feloniously and with premeditated malice, shoot and discharge a certain revolver pistol, which he then and there in his hands had and held, and which said pistol was then and there loaded with gunpowder…
