The plaintiff in error was at the December, 1893, term of the district court for Cass county convicted of murder in the first degree, the penalty fixed by the jury being death by execution, and which he now seeks to reverse by means of a petition in error addressed to this court. In the first *510count of the information the plaintiff in error and one Ben-well were jointly charged with killing the deceased, Mat.
