The action is for partition of real estate. The question is on the plaintiff’s title. The facts on which his claim' of title rests are: In 1871, John Murphy died intestate, seised in fee of the N. W. J of section 8, township 105 N. of range 23 W., leaving his widow, Catherine, and his children, Elizabeth, Margaret, Mary, John, and James. In 1872, the. widow executed to Elizabeth, Mary, and Margaret a quitclaim deed in the usual form of the real estate.
