This case concerns Modification 0023 (“Mod 0023”) to Contract No. DTMA91-95-C-00024 (“the Contract”) between Veridyne Corporation (“plaintiff’ or “Veridyne”) and the United States Department of Transportation, Maritime Administration (“MARAD”). The Contract was awarded through the Small Business Administration’s (the “SBA’s”) 8(a) program.1 Mod 0023 in 1998 extended the Contract for one year and four additional option years.
