Charles Peters appeals from a summary judgment for the Calhoun County Commission1 in his action seeking damages based on an allegation that the Commission had negligently designed, maintained, and repaired the roadway upon which Mr. Peters was injured in an automobile accident. The issue is whether the circuit judge erred in holding that Mr. Peters had presented no substantial evidence that any negligence on the part of the Commission proximately caused Mr. Peters's injuries.
