BLATZ, Chief Justice.
This is a pretrial appeal by the state, pursuant to Minn. R.Crim. P. 28.04, of an order of the district court suppressing blood test results in the prosecution of defendant for gross misdemeanor DWI, gross misdemeanor driving with a blood alcohol level of .10 or more within two hours, and misdemeanor driving without a license in violation of Minn. Stat. §§ 169.121, subd. 1(a),(e), subd. 3(c)(1); 171.02, subd. 1, and 171.241 (1996).
